请问可以告赢builder吗?

我近3年前买了现住房在维吉尼亚,前房主是第一任房主,男主人是律师。买房时检查房屋报告一条提出drive way和门前private drive way 没有final coating, and the pavement condition 也不算好。agent把房屋报告转给卖家via email,卖家又转给了builder. builder 回复给卖家说

DRIVEWAY:
xxxx,LLC.  will fix the sunken portions of the driveway when the last of the construction has been completed in the adjoining lots.   Several sewer line connections have to be made and the sewer main is close the the main roadway and within the roadway easement.  Once these connections are made and the roadway can be paved with a final topping,  xxxx, LLC.  will complete the work and turn the driveway over to the 5 parcel owners for maintenance per the easement agreements.
。。。。"
卖家通过agent转发这封email给我们做回复,因为builder措辞很痛快, 当时我们就没有纠结,签了合同,耐心的等他兑现诺言。
住进来后,那builder在本区的建设已完成,可是并没有管我们的drive way.
我发email数次给builder,
builder都不回。现听说builder的公司搬到佛州去,可能因为在维吉尼亚county 的 building相关部门的reputation不是很好,这边剩下的业务可能也转手了。
我们自己去做paving estimate价钱很高,每户从四千到一万多都有。现邻居们因各自的原因不愿跟这个builder打官司,
但都口头支持我们去打官司。有一个邻居大骂这个builder是个骗子,而且据他们讲那builder跟我房的前屋主女主人关系有点暧昧,所以那承诺是do her a favor而已。
我想请问我现如申请small court claim告builder,能有几分胜算?起诉时是否加上
前房主一起起诉, 因为email是会给他们再转给我们的,这样他们可以作证builder email回复是原件?
