The owner is liable only after SECOND attack. The first attack only establishes that the dog is KNOWN to be dangerous. Virginia is a mostly agricultural state, the law is protecting animal owners rather than victim. I think criminal sanction towards owner and dogs are unlikely, you will need a lawyer to get money damage.
