买房遭到欺骗, 求助

Last year, we bought a 18 year old house. Now, we found the siding is not installed correctly. The siding is tongue and groove cider siding. The correct way should be tongue upward and groove downward to prevent water from entering the house. In our case, tongue downward and groove upward. This traps the water and causes the damage to the house. Recently, we found one area inside the siding got rot. When we open that area, we found both rot and mold.

It is very expensive to replace the whole siding. We want to sue the previous owner and the inspector.

For the previous owner, he can claim that he did not find the problem.

For the inspector, he let us sign a contract during the inspection: “Any dispute, controversy, interpretation or claim for, but not limited to, breach of contract, any form of negligence, fraud or misrepresentation or any other theory of liability arising out of, from or related to this contract, the inspection or inspection report shall be submitted to final and binding arbitration. If no arbitration proceeding is initiated by either party within one year of the date of the inspection report, the failure to initiate the arbitration proceeding will be considered conclusive evidence that the parities are satisfied that each has properly performed their obligations under this agreement and any further action is deemed waived and forever barred.” Now, one year has passed and we are not sure whether we can sue him.

During the inspection, we let him check Radon. Firstly, he told us the result is normal. When we ask for the report, he said that the result is not normal. He said that he was wrong and so he paid us for the Radon mediation. We suspect that the money he paid us is from the agent or seller. If we could find the evidence on that, can we sue him that he intentionally cheat us?
