CASE STUDY--I-94过期怎么办 ?

A于2002年1月18日获得工作签证身份（H-1B）身份，INS的 Final Approval Notice 的有效期（Expiration Date）是2005年1月1日。

A于2002年7月回国，然后从xxx机场入境，鉴于A的护照将于2004年7月过期，机场海关官员在A的I-94卡上写了另一个Expiration Date， 2003年12月21日， 比INS的 Final Approval Notice 的有效期（Expiration Date）2005年1月1日早！去年底A延期护照，但是没有注意I-94。

由于A将延长（Renewal）工作签证身份（H-1B）身份。 才发现I-94卡的有效期（Expiration Date）2003年12月21日早已过期10个月，如何办？

Solution
To the viewpoint from INS, this is a very serious problem. They will think you have been illegally overstayed for more than 10 months. If A leave US now, this will trigger an automatically 3-year bar from re-entering US.


After A consulted different attorneys, they all say, do not leave US and solve it locally. Some experienced attorney regards it will be easier to go to airport custom instead of local INS (now USCIS) office.

A hired an attorney with some personally contact with the director in Custom Perception in airport (belong to Homeland Security Department). She went to the airport with A, and explained everything. The director had I-94 corrected in no time.

The lesson is to check you I-94 expiration date carefully. It has the priority to override all the other documents.
