Take a look at your divorce settlement whether there is a QDRO, qualified domestic relations order. For 401k, normally a QDRO is in order which specifies the way how 401k is distributed. It may be such that you would have to wait for your spouse to reach age of eligibility to share the benefit from your spouse' 401k.
