能以discloure不真实为由，退出并要回定金吗？

买一个 短卖房， as-IS。 开始贷款了 ， 但发现曾经有白蚁的损坏，（现在没有活的
白蚁的迹像），此地区不常见， 担心将来买时，难卖。 所以想退出。 对方代理威胁
我们将损失定金。 但我们发现在disclosure 中有一项问是否有白蚁曾经的损坏，卖方
回答，没有。
inspection contigency 已经没有了 。

我的问题是，能以discloure不真实为由，退出并要回定金吗？ 如果对方不退， 可以
去法院告吗？ 请版上有经验人士和法律专家赐教。
