I own a coop aparment in New York. I rented it out for two years and th lease ended first of March. The tenant (who is a single mom of a five-year-old and lives with her boy friend in the apartment) is still living there up to this day dispite my protest. Over the weekend, they told me that they can only move out on May 3rd.
The tenant actually works at a real estate law firm as a sacretary and she threatend that I cannot sue her since she's a single mom. However, since this is a coop building, the management threatend to sue me for violating the lease and sort for the eviction of the tenant. I was told that I need to cover all the cost.
What shall I do in this situation?
1) To find an atterny to send a warning letter to the tenant and urge them to move out on May 3rd? At the same time try to persuade the board not to start the legal process unless they fail to move out on 5/3rd?
2) What if the management insist to start the litigation now?
3) Shall I refuse thier Apirl rent as a stand?
4) Can I sue the tenant after they move out for the rent and other expenses due to their prolonged occupancy? and my chance to win?
I had to sublease my apartment because I was on company assignment to China for two years. I moved back mid February and had to rent temparary housing. My shipement from Beijing also needs temp storage and I need to hire movers later.
