cell phone ticket

I am just holding the phone but didn't talk. I got a ticket. Am I supposed to get this ticket?

I went to court and didn't plea gulity. Now I am afraid it is illegal even holding the phone. What can I do? I should have chose to pay the fine. Sigh.
