Thank you, apt, for the answer. I have a followup question.

Since this is a small case, I was thinking of a small claims court. Based on what you said, I can file the lawsuit in a small claims court on behalf of my principal. Can I appear in a small claims court on behalf of him?

If not, then the only choice is to hire an attorney to file a lawsuit in California Superior court because attorneys are not allowed in small claims court. 

Am I right?
