麻烦的是我的租约中没有提前解约的条款。对方没有给我任何书面通知,只是口头。
我查到加州关于押金的法律(CaliforniaCivilCode1950.5):“No later than 21 calendar days after the tenant has vacated the premises, ………the landlord shall furnish the tenant, by personal delivery or by first-class mail, postage prepaid, a copy of an itemized statement indicating the basis for, and the amount of, any security received and the disposition of the security and shall return any remaining portion of the security to the tenant.我理解这21天是从房客搬出之日算起,是这样吗? 我已早过21 天了,因为还没找到新房客, 我以为可以用押金抵房租。 至今我和房客之间也没有正式解约。我的问题: 1. 对方能否用逾期不退押金来告我? 2。我给他发去解约协议,他不理睬,怎样单方面解约? 3。在没有正式解约(书面)前,我能否和新房客签约?谢谢!
