Does anyone here know a good lawyer in San Diego area? Please advise. Need help!
I can not type chinese on the office computer, so hope I can make my clear with English.
I am living a condo, downstair, there is only one neigbhour as above. Almost two weeks ago, I found out there was a leaking from the ceiling down through the wall in my laundry room.
I used send email with pictures to HOA, and HOA sent a plumber last week. The plumber checked both my unit and the upper unit, and he think there is a drain broken between two unit but he doesn't know that is belong to HOA or the neigbhour until open the wall. HOA said that water came from the upper unit, so that is my neigbhour's respone*****ility.
The upper #509 called her insurance, but her adjuster told her that because there is nothing damage in her unit, so her insurance company won't make a claim for that, even won't send a perfessional to check. And they told me that I have to make my own insurance claim. The HOA manager told me that "Unfortunately, there is nothing the HOA can do. If you file a claim, it seems your insurance will go after their insurance in order to fix the problem. Since it would appear they would be at fault, you might be able to have your deductible reimbursed"
I called my insurance company but they said my poicy won't cover that. I back to talked with my upper unit #509, suggested if both HOA and her agree to hire the company who checked last week, let him to open the wall to check that is belong to which unit or HOA. But, she keepping say" There is nothing need to talk about, my unit is no damage here, and my insurance won't do anything."
Now, I think I need to get a lawyer to see if I can make a lawsuit. Thank you to read and advise.
