sold as is 合同， home inspection 出问题可以要回ernest money 么？

买的estate home, offer 合同上有home inspection contigency. 但合同接受单上说所sold as is。 现在home inspection 发现foundation problem. 卖方拒接维修也拒绝给任何credit. 请问这种情况可以终止合同并要回ernest money么？ 多谢！
