Every law school teaches a famous tort case in first year. Lubitz v. Wells. Plaintiff, a 9 years old, went to play with defendant's son, 11 years old, on defendant's yard. The 11 years old swung a golf club which the defendant left there, struck the plaintiff in the head, causing injury. The jury found for the defendant and the club was not intrisically dangerous that would constitute a negligence by the defendant. You may argue a shovel is different than a club but I think your chance of hold your neighbor liable may be really slim. The questions were to make sure your son was not a trespasser and things like that.
