去年底,在创纪录的连日暴雨过后,我们的邻居来抱怨我们的紧邻他们主卧的花坛造成了他们的主卧渗水,当时我们还到坛里咨询过大家。我们的小区是SFH,建于89年。比较特别的都是 Zero lot property, 每家后院里有一侧和邻居的屋墙是紧邻的。花坛不是我们建的,而由于在私人院里建花坛是不需要Permit 的,我们也无法找出是哪一任前屋主建的。 后来我们报了保险公司,邻居的损失由我们的保险承担,可我们要自掏 $5000 在我们的花坛和邻居的屋墙间挖了一条沟. 本以为这事就做了一个解决, 这时City 插了进来,要我们把以下的文件到County 做 recording. 我们问了几个建商,他们都说建筑法没有任何关于私人花坛的规定。
请问各位:1. City 要求我们这么做是合法的吗?他们这是不是管到我们的私人地界里了? 2. 如果我们这么做了,将来我们要卖房时会有什么不良影响吗?谢谢!

- The planter installed on the north side of address# adjacent the house wall of address# shall be continuously maintained for proper drainage and free of debris.
- All drainage devices shall be maintained in working condition, repaired when damaged, and not modified without the City’s approval.
- Landscape sprinklers shall be directed away from building structures.
This covenant and agreement shall run with the land and shall be binding upon ourselves, future owners, their heirs, and successors and assignees and shall continue in effect until and unless approved otherwise by the City of ###. It is specifically intended that the benefits and burdens of this covenant run with the land.
If the City is required to bring legal action to enforce this covenant, then the City shall be entitled to its attorney fees and court costs.
