各位大侠帮我看看， 这种情况能不能把deposit要回来

孩子今年在private school上学， 去年六月份交了deposit， 然后又写了12张支票， 从7月到今年6月。 现在开始下个学年的pre-registration， 学校的规定是二月底以前通知学校， 如果回来， 那么六月的支票就是明年的deposit， 如果不回来， 那么六月的支票就会退回来。 我二月底还没有确定是不是回到这个学校， 就既没有说要回来， 也没有说不回来。 现在新学校定下来了， 我通知现在学校说不回了， 他们说因为过了deadline, 六月的deposit不能退了。 这种情况我应该怎么争取？ 学校的newsletter上有写如果想拿回deposit， not-register is not enough， I have to send a written notice for withdraw。 但我觉得学校这样收deposit, 但并没有reserve space for the student， 也不对呀。 而且， 我没有签任何明年注册的文件。
