we are still living together for the sake of our kid, can I choose married filed jointly for 2009 tax return or I have to file as a single or the head of a household?

on xx 2009, the court having reviewed the case. any existing spousal support order shall hereafter be deemed an order for Alimony Dendenta Lite if any economic claims remain pending and it is decreed that the plaintiff xxx is divorced and separated from the bonds of matrimony contract between xxx and the defendant. The court hereby retains jurisdiction of any claims raised by this action for which a final order has not yet been entered.
