Legal or Illegal. Please help.

J-2 EAD 有效期至明年7月，但J身份在今年7月已经到期，H-1B在grace period 已经file 到移民局，还未approval。我的移民律师说现在工作合法因为有EAD，但有些说不合法. Could you let me know your opinion and if there are any effect for my H-1B petition? If illegal, what is the penalty? I really appreciate your help.
