被印度老板欠薪3万，可以要的回来吗

今年6月开始在一家印度人开的公司上班，雇主给申请H1B，10月才开始生效。老板说没关系先干着，工资10月份后再发。结果过了10月后雇主找各种理由拖着这4个月工资不发，马上12月了，估计他们也不想给我发了。我其实也要EAD卡，理论上来讲我是可以10月前工作的。因为前几个月没有签合同，这钱还可以要的回来吗？需要通过什么途径？需要请律师吗？
马上要换工作了，钱还没到少，生活拮据呀。先谢谢大家了。
