再问:关于房屋买卖


根据本洲的法律,SELLER 需要提交CLOSING DOCUMENTS 在CLOSING DAY (见下面英文段落1,摘自买卖合同) ,但是我的SELLER 没能够提交相应的文件.所以我的律师告诉我可以不买或等他们的文件.因为一些个人的原因,所以决定不买.但是被SELLER 的RELATOR 威胁,他声称不会退还我的定金,并且还会起诉我 关于他的COMMISSION 和如果房子再卖的价格差. 根据坛子朋友们的建议,我又再次看了一下买卖合同,(见英文段落2),觉得我对于他没有理由不归还我的定金,并且我不需要负担他的COMMISSION 和房子再次上市后的价格差.

1. The Seller or the Seller’s lawyer will deliver normal closing documents including, where applicable, a real property reportpursuant to clause 4.11, to the Buyer or the Buyer’s lawyer upon reasonable conditions consistent with the terms of this Contract.




2."If the Seller or the Buyer fails or refuses to complete this Contract according to its terms, then the other party may pursue allavailable remedies. The Seller’s remedies include keeping the Deposits and claiming additional damages. Both the Seller andthe Buyer can claim reasonable costs including legal fees and di*****ursements on a solicitor/client full indemnity basis. "
