a. if you don't have fund in your account, your bank will NOT honor your check. Otherwise the bank loses money, get it? The fine is the penalty for you to make that situation possible to happen.
b. you pay for your mistake. The bank is reasonable enough to waive your 3 charges. You can always try to ask more, but you are at the mercy of their hands.
