About J 1/J2 change status

About our visa situation. It's really a little different from others:

1) My hu*****and is a J1 student (MBA exchange program, 4-month), my daughter and I are J2. From the documents my hu*****and is not subject to the two-year home Country residence requirement, so I'm quite sure that me too at the begining. During this period, I applied for a Master program in U of Minnesota and got admission last month. But while we prepare to change my status to F1 and my hu*****and and daughter to F2, we found we are in big trouble.

Following are the visa and DS-2019 information for us three:

Hu*****and:
J1 Non-Degree Student
DS-2019:Not subject to the two-year residence requirement
Visa:Not subject to 212(e)

Wife: J2
Visa: Subject to 212(e)
DS-2019: Didn't mention

Daughter:J2
DS-2019:Not subject to the two-year residence requirement
Visa:Not subject to 212(e)

So, my hu*****and and my daughter are not subject to 212(e), but I am. So I cannot change my status to F1 in USA. I believe this must be a mistake but I can not find any way to get my waiver and the time is also not enough.

At first my hu*****and decided to extand his J1 visa by applying a degree program. But only till last week the advisor told us he can not change to a degree program unless go back to home Country or the third Country to get a new visa.I think the risk is too high.

My question is that if a lawyer can help us to find a way to change our status to F visa in USA without going back to home Country or the third Country to get a new visa. If not, what's the best choice for us?
