8老师您好！我的NIW based 的 I485是2021年11月提交的，两周前收到RFE需要新的693，下周将寄出新的693。我2019年11月曾经去485绿卡面试，USCIS因我在当年夏天回国给否了（其实我的第一次485所linked的EB1b被拒了，485应该要被据掉的）。

1. 我的O1签证2月11日过期，可是我现在没有EAD, 也不能再续签O1, 请教在等待绿卡期间为保持合法身份，我需要做什么？

-Your status will be Adjustment of Status after the O-1 expires, so you don't have a problem to stay in US, but you cannot work in this case unless you have EAD..

2. 我想拿到绿卡后就先回国一段时间，所以还没有跟雇主谈继续工作的问题。2月11日之后，我可以失业在家等绿卡吗？还是最好继续为雇主工作，以免485因失业被拒？

-I would sugest you to extend the O-1 and continue to work for the employer until you get the green card in case USCIS ask for your employment status before they approve your I-485. Of course, if you have EAD to work, then you do not have to extend your O-1 status.

3. 我在2021年9月提交了485+131+765，131+765 两周后就接到收到通知，但是485因为申请费弄错了两次一直到11月底才被接受，12月底通知以前做的Biometrics 仍有效，不必再做。我的绿卡不知啥时能获批，请问我的131 AP有可能在绿卡拿到之前获批-吗？

-Yes.

如果绿卡还需要8、9个月甚至更长时间才能拿到的，我想5月份回国，可否申请加急AP?

-Yes. You can call USCIS to make an appointment with the local USCXIS Field Office to apply for the emergecy AP. Prepare the justtification on why you need to travel urgently.
