未婚妻有B2签证并计划春节过来美国结婚。我是绿卡。请问

1 结婚后多久，她的绿卡申请可以起动?-You may file I-130 in about one to two months after marriage. 

再问8老师：如果结婚后立刻file I-130 会有什么负面影响？
-Hard to say, but because B2 visa holder can not have immigration intent, USCIS might think she is not honest when apply for the B2 visa if she marry you and apply for the green card immediately (of course, this is just a guess).

 

2。现在visa bulletin F2A排期是2013 年九月。只是等两个月。我有没有理由合理推测，我未婚妻的I130 在明年二月提交后，也只要等几个月就可以交485？-Hard to say.

 

3。结婚后，并提交了I130后，我太太还能以B2回国一趟处理一下私人事务，并再以B2回美国吗?-Very risky due to immigration intent.

再问8老师：这个risk是指美国海关会阻止她再次入境吗？-Yes.

因为她的B-2是明年九月过期，且是多次进出境的（不用去领事馆从新面试）。

另问8老师：如果结婚后，不file I-130，她还有这种risk 吗？-should not.

 

4。我太太的I130 提交后，她能以B2的身份呆在美国等待吗?-Yes until the B2 status/I-94 expires, but it is difficult for her to extend the B2 status due to immigration intent.

再问8老师：如果B-2没有延期之前，我们file了I-485， 她还能继续呆在美国 without B-2 status 吗？-Yes, she needs to file I-485 before her B2 expires

 

5. 婚妻将在春节以旅游签证赴美同我结婚。我有绿卡。然后她申请语言学校（它们给发i20).请问她呆在美国的这段时间，她的身份怎么才能转成F1？

-had better do it 2 to 3 months later after she enters US. Also she has to convince USCIS that she has no immigration intent, otherwise her F-1 will not be approved. So, she may change her status to F-1 first and marry you later (at least file the F-1 application first, then marry you). 并大概要多久啊？-3 to 6 months, case by case.

再问8老师：如果我们先不结婚，先把她转成F1。转的过程中她的B-2能否延期？-Yes, but if F-1 approval first, then B2 approval later,, her status will be B2, not F-1. By the way, after she filed change of status to F-1, she can stay in US legally during the F-1 pending. So, she may not need to file B2 extension if she files change of status from B2 to F-1.

我怕6月不够？

转成F1之后，我们在结婚，给她办绿卡。可行吗？-That will be fine, but if you file I-130 for her, she can not leave US before she filed I-485 (she can leave US using AP after I-485 filing).
