you can get the H1 approved in one month if you use premium processing. Technically, if you leave US during the H1 pending, your H1 applicaiton will be void. But if you use H4 visa to come abck, your I-485 will be safe even if you do not have AP. If you are urget to leave, another choice is that you may just leave US and use H4 visa to come back and then, ask your employer to file H1 after you reenter US, not file the H1 petition before you leave US.
