今天去了Infopass, 对方让我file I-539.

-This will not work because you have been out of status.

律师让我回加拿大或者中国， 再进来。

-Fine if your unlawful presence is less than 180 days.

请问8老师， 如果去加拿大， 回美我还需要签证么？

-You must get the visa such as H4 visa to enter US unless you are Canadian citizen.

是不是可以利用30天内去加拿大， 不需要签证；

回美， 移民官会依据我的I797给个新的I94?

-No I-797, but a new I-94 such as H4 I-94 (corresponding to your visa) as you entered US first time. Don't forget to submit your old I-94 (expired one) to the airlines or the US CBP officer when you leave US as eveyone does.
