回8老师， I-94 expires, H4 out of status问题

今天去了Infopass, 对方让我file I-539.

律师让我回加拿大或者中国， 再进来。

请问8老师， 如果去加拿大， 回美我还需要签证么？

是不是可以利用30天内去加拿大， 不需要签证；

回美， 移民官会依据我的I797给个新的I94?
