1.       我的儿子明年1月15日即将满21岁了，我的I-140 Receipt date 是2010年4月13日，Notice date是2010年5月14日，我的EB-2 priority date是2009年7月16日，是否我儿子21岁的年龄可延长30天（2010年5月14日减去2010年4月13日）？换句话说：如果明年1月份公布排期超过我的priority date，我的儿子就有资格随我一起在2月1 日递交I-485，对吗？

-Your undersatnding is not correct. The CSPA age of your child = your child's age at th time your排期 is current - your I-140 pending dates.

 

For example, your 排期 is current on Jan. 1, 2013, your child age at that time is 22, and your I-140 is approved on April 13, 2012 (pending for 2 years), then your child CSPA age = 22 - 2 = 20 < 21, so your child is qualifed for filing I-485 at Jan. 2013. 

 

2.       我的儿子刚从H-4转为F-1，F-1可以随主申请人递交I-485，对吗？

 -Yes.

  

3.       不需要无犯罪记录公证，对吗？

 -Correct.

4.       如果明年1月份公布排期没有超过我的priority date，我的儿子有任何补救方法随我一起在3月或4月递交I-485吗？

-No other way if he i age-out.

因为他随我来美国多年，美国高中毕业，较早随我递交I-140且获批准，我想仅仅相差一、两个月我的儿子就失去现在移民的资格对他来说实在太残酷了。
