-No. Only count I-140 pending time because PERM is not counted as the immigration petition (immigration petition means I-140 filing, I-130 filing, etc).

Here is the formula for calculating the CSPA age of the alien child which involves two dates:

(1) the age of the alien child on the date on which an immigration visa becomes available for his/her parent's immigration petitions; and
(2) the number of days the immigration petition is pending

The age of the alien child = (1) - (2)
