have a good new that my hu*****and & my green card are both approved after 10 years waiting. But we worry my daughter’s status now.
We did not apply her I-485 with us.
-Why did she file the I-485?
1. She went back China with H4 at the end of June for summer vacation.
2. She got her H4 visa at China Beijing Embassy at the early July.
3. After that, our green card were approved on July 29 by email( have not received cards yet).
My questions:
1. Is my H4 invalid the minute my green card is approved?
-Techinally, her H4 visa is invalid. But she may come back using the H4 visa as soon as possible and if the CBP officer find your GC was appoved, your kid may just say she has no idea about that and explian it to the Officer to see whether the office can issue a B2 status (I-94) to her to enter US (sometimes the officer may do that and it is reasonable).
Another choice is the your kid may apply for the B2 or F1 visa to enter US.
2. If yes, could she still come in USA with her H4?
-Yes.
We really worry about her status since she supposed to come back to school at 8/31 to continuer her 10th grade high school.
