Assume a scenario like following:

Wang Wu began his H-1B on 10/1/2003, and has an I-485 pending. His H-1b was extended beyond 6-year, from 10/1/2009 through 9/30/2012.  On 7/5/2010, his I-485 was denied.

Based on the statement of "在H-1B超过6年后不可靠，因为一旦I-485被拒，依靠I-140延的6年后的H-1B无效",  do you think Wang Wu's was out of status on 7/6/2010?
