急急急！h1b transfer被拒。求帮助

去年8/31号h1b第一个3年到期，到期之前丢了工作。马上file了h1->f1 on 8/26. 9月20号新公司file了h1b transfer. 10月h1->f1批了。刚刚收到移民局h1b transfer rejection letter，原因是9月1号到9月20之间没有身份。。。。。。

律师说那段时间我是h1->f1 pedning status，是legal的。律师认为是个goverment error，能appeal。
