回复：紧急求助, I-131 RFE

问题1: 移民局可能猜到或知道我妻子先出国后交 AP I-131 Form 申请, 请问这是否违法?

-This AP application (I-131 filing) is invalid. Just tell USCIS (response to the RFE) that your wife has left US and then, USCIS will deny the I-131.

 

问题2: 移民局要护照各页, 恐怕先出国这事是瞒不住的, 是否要如实告之?

-Tell the truth and then, no any negative effect. YOur wife needs to get the H4 or H1 visa to come back if her status was H4 or H1 before sahe left. Otherwise, her I-485 will be invalid and she may not get the B1/B2 to enter US due to immigration intent.

问题3: 第1条, 第4条没问题, 第2条可让妻子把护照各页复印寄来,  第3条I-94表, 过去的几张有复印件在, 但最近一次的I-94表 (2009-12 issued) 3月23日出关时交回航空公司了, 没留复印件, 不知怎么办?

 

问题4: 我们的绿卡是职业第二优先, 优先日是2006年4月20日, in current. 估计也快审批了, 这事是否影响,  恳请pjiang,8大侠赐教为谢.
