I just got RFE for my I485. It asks for the proof of that I was lawfully admitted to the US as a nonimmigrant prior to filing my case. It requires a copy of I-94 issued upon my last admission or explanation if no I-94. My current I-94 is detached from my H1B approved notice but it is not issued on my last admission. In my original submission, I have enclosed its copy.
-Just provide that copy of the I-94 again when you entered US at the last entry (e.g. from China) and the copy of the visa for the last entry (in your passport). This RFE does not require "My current I-94 detached from my H1B approved notice".
My last entry to US is from Canada but no new I94 was issued because I drove to Canada and back on the same day.
-You also may explain it in the response letter that when you went to Canada and when you came back using the "visa automatic revalidation rule" and thus, you were not issued a new I-94.
When driving into the US, the office on the border just checked my passport and H1b approval notice and let me in without issuing I-94 and without any stamp on my passport.
