-You do not understand that the H1 petition is sometime different from your status. Even if your status is not H1 after your H4 is approved, the H1 approval is still valid and thus, you just go outside to get the h1 visa to come back and your status will be H1 again. Your employer does not need to file an H1 petition again.
If you do not file the H4 applciation now and you do not find a job before the h1 I-94 expires, you will be unlawyfully present immediately after the H1 I-94 expires, and your h1 petition approval will have no I-94 and you still need to go outside US to get the H1 visa. If your unlawful presence is long, you will have trouble to get the H1 visa.
