I worked for 2 months while H-1 was being prepared, was changing from H-4 to H-1. Before H-4, was H-1.

Some said that two months of work while H-1 was being prepared was legal, because I had H-1 before H-4, so LCA was still valid.

Other said those two months of work while H-1 was being prepared was not legal.

It was less than 180 days, I went to US Virgin Islands for vacation after H-1 was approved. On the way back, customs stopped us asking for visa, we said we were on H-1, did not know that there was customs from USVI to 50 states, they found us on H-1 in computers, and let us in.
