我一直在同一家公司工作，现在还是H-1身份，只是最早的H-1 签证早就过期。I-485 排期未到, 去年夏天用AP回国, 入境时没给新的I-94卡, 就在入境卡上盖了个章, 写着 "Paroled till 2010年9月”, 同样的章盖在了AP上. AP的到期日是去年年底. 我原来以为这是相当于把AP给延长到今年9月,所以没有去RENEW AP. 下月初需要出境一趟, 去加拿大5天, 来不及申请新的AP, 签证也要预约也麻烦 (还没查, 不知道来不来得及约),

看到网上有人说去加拿大如果不超过30天, 只凭有有效的I-94卡就可入境。看到这个刚开始很高兴, 可我的律师说这个规定不适用于H-1, 只适合学生和访问学者.他说那个章不是AP renewal,
-The lawyer is wrong. It absolutely also applys to h1 visa. I want to know whether you have extended your H1 after you re-entered U.S. using AP last year. If yes, you have no problem to go to Canada with the valid H1 I-94 which is issued with your H1 extension approval notice. If you did not extend your H1 after you used AP, the problem to you is that your current status is not h1, but parolee because you used AP to enter U.S. last year though you can work for your employer (same employer) without using EAD. So, technically you have no immigration status by this point and of course you can not use the Visa Automatic Revalidation rule to travel to Canada/Mexico. Thus, you can only can get an H1 visa to come back.
