怎样才能让老婆，孩子顺利返美？

本人一家当前身份 AOS。雇主已明确不给H1b。LP无专业，也不可能获得H1b。

本月20号前，我还持H1b，LP H4（有效期从2008年2月8号至2009年10月20号）。10月20号之后，我将持EAD继续为原雇主工作，原雇主不再为我延H了。

9月15号，LP紧急回国，带着一个1岁半的孩子。他父亲10月2号去世。情急之下没有办AP。丧事之后，LP立即预约广州，希望能赶在10月20号之前回美。LP10月15号面签，顺利通过。但直到21号才拿到签证。没想到，上面竟然写着：签发日期：10月19号，过期日期：10月20号。

现在好了，H 没有了(out of status,原雇主不给再延）， LP 也过不来了。更要命的是，我这里还有一个3岁大的，每晚哭着要妈妈。

请问：像我这种情况应，如何才能让老婆孩子尽快返美？



附：绿卡申请情况介绍
我的 I140（EB1a)在2007年9月就批了。I485没有和140同时递，485的received data 是07年8月17号； notice data 是 07年10月16号。尽管是EB1a，485却赶上了大放水。因此到现在也没绿。

Texas I485 的平均审批时间是 23.9 个月 （Texas Service Center - 23.9 Month）。而我的case已足2年了。
