回复：I-140刚批下来准备递485，却出现新情况

我是H1，我LD是H4.
今天发现我LD的I-94还有两个月就过期了。而我的还五个月过期.
我想问一下,这种情况能递485吗？
-Of course, why not? As long as your PD is current, you can file the I-485 unless your unlawyful presence > 180 days.
还有，等485批准期间如果LD的I-94过期，需要申请延期吗？
-You had better extend your H1 status to work. If you do not extend the H1, you have to use EAD to work. But you can legally stay even if you do not have H1 status (your status is AOS in this case).
