１）我的I-94目前还是在有效期内，而且out of status是小于１８０天，这种情况下，向移民局递交transfer 申请，应该是会批准的，对吗？（记得网上看过一篇文章说今年移民局对有gap的申请放宽了一些）
-Yes, but Most likey the application will have no I-94 card and thus, you need to go out o U.S. to get an H1 visa to activate your H1 status.

２）要出境申请h1b visa 的话，是不是可以去墨西哥或者加拿大呢？

３）如果一定要回中国签证，可否可以不在户口所在地所属的领馆申请，因为时间紧急，想着哪个领馆能预约上就去哪儿签。

还有这种情况可以去美国驻香港领馆签吗？

刚才公司的hr lady打电话来说，律师希望我尽快离境去签证，我和她说我必须等到h1b transfer approve后发给我新的I-797才可以走，因为没有I-797number,我连签证预约都没法约，大家说我给的这个理由充分吗？
-You are right. You had better get the approval notice beore you leave U.S. If you are lucky to get the I-94 with your approval notice, you do not need to go out o U.S. and just go to work directly. Anyway, you had better use premium processing to get the H1 transfer petition approved within 15 days.
