请教：J-1 Waiver正在等待时可以开始永久居民身份申请么？

有几个问题请高人指点。

1：我的waiver是用extreme hardship -- 先生是终身教授，并患有terminal disease。请问这样的case自己填表、写statement的把握大么？有需要请律师么？我看了xiaobaitu的讨论感觉我们的情况可以establish a strong case，他不可能和我回国待两年的。

2：我先生下周归化入籍（这漫长的等待我以后另文叙述），由于用extreme hardship办waiver据USCIS的网站上的信息需时3-4个月，到时我的J-1居留已过期，而中间我有可能找不到下一个J-1的工作，这段时间算合法在美国居留么？

3：因此我们计划在他宣誓后马上交绿卡申请，这样做可行么？ 可以同时申请工作许可和旅行文件么？
