shocking news nc memo not work

just come back from a local GC interview (EB based). Immigration officer indiated that cannot aprrove my GC since name check not clear. And now uscis is very careful about name check issues, officers are instructed not to tell applicants any reasons,(but I met a very nice officer) my hu*****and name check cleared 2 days ago, so his is approvable after redo the finger print, but mine is not.

My lawyer also said that USCIS is not applying memo in the real practice.
NC memo is another good on paper bad in practice policy.

bad luck and God knows how long I should wait. can anybody provide any suggestions what could I do now?
