filed WOM, local atty office asked to dismiss case, what should

We file WOM in December 2006 and I inquiried the local atty office. A paralegal assistant told me that she is going to file emotion of dismiss because it is reasonable for any time frame for FBI to do name check. and they cannot make that jurisditional charge againt them.

When I asked if they can contact FBI to push the case, she said they are not able to do that after 12/31/2006. What should I do as next step? Our I485 has been stuck on name check for almost 5 years.
