1. You get pay for three months, but it doesn't mean you still have a valid H-1b. It should be valid 10 days after you h-1 lay off. 485 righ now is ok for you. The only problem is when you are interviwed, you could not prove that you are qualified becasue of the gap. So, it may have problem some days later.
2. Yes, your lawyer said you could not extend your h1b becasue of laying off. If you get new h1b job, it should be called h1b transfer.
3. Yes, it is a good choice to get F and then back to h1b if it is not over 6 years.
