xiaobaitu, mytwocents, and other expertises please help!

查了以前的帖，但没能查到想要的答案。只好请问各位好心人以下两个问题。
背景：先生是H1B(his H1B will expire in January of 2007, but he will get it extended to 2010 soon this year), I140 已通过,现在是485 pending.我们想用 AP 回国一趟，4年多了，来了之后就没回去过。我的问题是：如果我先生用了AP,回美后他任在同一公司工作，他的 H1B 还有效吗？我的意思是,他是不是必须要重新延期才能继续使用他的H1B身份？（我看到有的帖子说一旦使用了AP身份就变作AOS 了.如果是这样的话，今年延期就白延了）。
我的身份是H4, 有工卡但没用过.我的H4明年1月过期. 我的第二个问题是:我需不需要延期?如果不延,过了明年1月,我又没有使用工卡，我的生份是不是就黑了?
