As far as I know, as long as have receipt for H1B renew/extension, an automatic extension of 240 days are given to the applicant. No matter it is premium or regular process.
-You are right only if the H1 petition has to be file before the current H1 expires. But his/her situation is different. Because his/her H1 expired before he/she was file the extension petition (technically he/she was out of status), he/she can not continue to work until the H1 petition is approved
