置疑律师， 再问 university H1B extension + April 1 industry H1B，

我正办理大学H1B延期，同时公司在准备我四月1号占CAP H1B 申请。 问题是我延期申请只能在3月25号提交，在公司3月31号递交H1B前无法拿到延期reciept，因为预测4月1号当天H1B全部用完。 律师认为

(1) " We must apply for straight H1B, which requires you to depart U.S and come back, because before April 1st, you have GAP".

(2) If we do not apply for straight H1B, you will loose the chance to get H1B, because "If we file without the approval, it is likely
that a remand will be issued on the case and we will need to respond with
proof that the extension was approved."

我请教了pharmacyelite 和 pjiang, 好像他们的分析都不赞公司律师的观点。大家认为避免上诉(2) 发生的最佳方法是不是如下

(1) In industry H1B petition, include copies of my university H1B extension, including LCA, Offer letter, prevailing wage, actual wage report, I129 forms, such that VO has sufficient information to adjudicate my case.

(2) Even after March 25, 2008, apply premium processing to get H1B extension as early as possible.
