H1B renewal question - urgent!!

I have an urgent question regarding my H1B renewal. My first 3 year H1B is expired this coming 10/1. And I am planning to go back to China this coming Sunday (9/23). My lawyer told me it is okay, I do not need to bw worried as long as I have the receipt of H1B renewal from USCIS. Is that true? Would I be introuble to get a visa back to US, since my old one is expiring, and I have not received any new !-94 yet. Would I receive any approval for H1B renwal? Or it is automatic, only receipt form USCIS would be sufficient? I do not need any approval from USCIS?

I am so stupid and just thought about it now. And my ticket is this coming Sunday. If anyone can give me the answers whether I am okay or not, it would be greatly appreciated!!!
