请教一个eviction的问题

我一个房子是每月23号到期欠$1920，28号给房客发了eviction notice, 1月2号房客zelle了$400和一张支票，支票银行拒收了。（我的PM老了! 连Check上有涂改都没看到，我正在自己远程接手）。他发了$400给我，这种情况我可以开始eviction process吗？还是得重新发eviction notice？
