Interesting approach to attempt at getting out of having to pay. I would send the upstairs landlord a bill for the repair with a note that I will be filing a small claims court case in 2 weeks if it isn't paid.
Or you could ask State Farm how you appeal their decision and threaten to elevate it up to your state's Attorney General and Insurance board. You can even probably find an ambulance chasing lawyer that would represent you on this knowing they will get their bill paid by the insurance company when they settle.
The bottom line it was a failure in his unit (IE: his dishwasher or his tenant who knows which) that caused damage to your property. The VA landlord tenant laws refer to how a landlord and a tenant are required to interact, it has nothing to do with one property owner to another. He is more than welcome to pursue his tenant for reimbursement per those laws once he pays for damage that was caused from his unit.
