出租房又发现老鼠怎么办？

之前就发现过，我花了$600请了专业人员来处理，现在不到一年，房客说又发现老鼠，要我再去找专业人员，我和他们协商一人出一半，房客不同意，说是房东的责任。

这个钱是无底洞，该堵的地方都堵了，不知道老鼠是哪里来的。以前的房客从来没有反应过。

现在的lease是month to month contract，我可不可以要求房客搬走？会惹上官司吗？
